TERMS / VERSION SITES-2026-10-13-V1
Terms of service.
Clear from the start.
Effective 13 October 2026. These Terms apply when presented for acceptance before NovaSoft Sites registration or purchase.
1. Provider, agreement and eligibility
NovaSoft Sites is supplied by NovaSoft Technologies Pty Ltd (NovaSoft, we, us), ABN 31 694 025 379, ACN 694 025 379. Contact us about the service, legal requests or abuse at help@novasofttechnologies.com. This is a temporary working address until a replacement is published.
The contract consists of these Terms, the Acceptable Use Policy, and the plan and price shown at the time of purchase. The Privacy Policy explains our handling of personal information; accepting these Terms does not consent to unrelated marketing. If the plan display and these Terms conflict about a price or included allowance, the specific plan display presented before that purchase controls for that purchase, subject to applicable law.
An account holder must be at least 18 and able to enter a contract. A person acting for a business or other organisation confirms they are authorised to bind it. We may ask for reasonable information to check authority or prevent fraud. Do not create an account for someone else without their permission.
2. Accounts and access
Give accurate registration and billing details, keep your credentials confidential, and tell us promptly if you suspect unauthorised access. We may require email verification before account features are available. Do not share an account as a substitute for team access; one verified account owns each site at launch.
You are responsible for actions taken through your account to the extent those actions are within your control. We remain responsible for our own acts and omissions. We may suspend access temporarily when reasonably needed to protect the service, investigate misuse or comply with law, following the process in section 11.
3. What the service includes
NovaSoft Sites provides original templates, a visual editor, private account drafts and, when enabled for the selected plan, publication of one customer website on an allocated single-label subdomain of novasoftsites.com. An allocated address is a service feature, not ownership of a domain name. We may reject a label that is reserved, misleading, infringing or unsafe; we will not silently transfer an existing customer site to another account.
Guest drafts remain on the browser or device until an account save is acknowledged by the server. A device draft can be lost if browser data is cleared or the device fails. Export important work. A saved account draft is private; publishing requires separate eligibility and successful activation. A failed publish must leave the previous successful release in place, subject to current account and payment authority.
AI generation, team accounts, customer custom domains, arbitrary customer code and NovaSoft One CRM transfer are unavailable at launch. Expand is unavailable and cannot be purchased until its allowances and service are defined. A customer can explore Pro templates in a private draft without gaining a right to publish Pro material on Free. Domain registration, custom design services and third-party subscriptions are not included unless separately agreed in writing.
4. Plans and usage limits
Free permits one published image-free page on its allocated host, with up to 10,000 published requests per UTC calendar month. It does not include uploaded images, managed enquiry forms, AI or custom code.
Essential applies to one website and includes eligible Pro templates, multiple pages and approved images, up to 1,000,000,000 stored asset bytes and 50,000 published requests per UTC calendar month. A mailto link opens a visitor’s own email application and is not a NovaSoft managed form.
Grow applies to one website and includes Essential features, up to 3,000,000,000 stored asset bytes, 150,000 published requests and 300 managed enquiries per UTC calendar month. Grow enquiries are stored in the site owner’s account inbox; an email notification is addressed only to the verified account email. The owner remains responsible for handling enquiries lawfully.
The server measures and enforces these limits for the relevant site. At an included limit, the affected upload, request or enquiry may be refused or paused until a new period or an approved plan change; there is no automatic overage purchase. Request counts include published site traffic, not private editor use. We may apply proportionate abuse and security limits that do not replace the stated included allowances. We will explain a material limitation before purchase where practicable.
5. Prices, tax and payment
The monthly prices are Essential A$39 and Grow A$59 per website per month, shown in AUD including GST. Each subscription covers one site. There is no NovaSoft One discount at launch. The applicable total, billing interval and tax treatment are shown before the customer confirms Stripe Checkout.
The first monthly period is charged when the customer confirms Checkout. The subscription renews and is charged for successive monthly periods unless cancelled before the next renewal. Stripe processes card and billing details on its own service; NovaSoft receives the customer, subscription, invoice and payment-status records needed to administer the plan, rather than the full card number. Stripe may provide receipts and tax invoices through its service.
A paid entitlement starts only after we receive and verify the required completed Checkout, active subscription and paid invoice evidence for that exact site and plan. A displayed plan selection or an unconfirmed payment does not grant paid publication. If payment fails, is reversed or the funded period expires, paid serving and paid operations can stop without an automatic grace period. The account owner may still contact us about recovery and applicable remedies.
6. Cancellation, plan changes and refunds
The account owner can use the linked Stripe customer portal to update a payment method and cancel a paid subscription effective at the end of its current paid period. To avoid the next renewal charge, complete cancellation before Stripe starts that renewal. The portal shows the effective date. Self-service plan switching is not available at launch; contact help@novasofttechnologies.com for a proposed change and its price before agreeing to it.
Cancellation stops future renewals but does not itself erase account drafts or previously stored releases. Published paid content can stop being served when the funded period ends. Ask for a source export or account closure through the support address. Device drafts remain under the user’s browser control. See section 12 and the Privacy Policy for retention and request handling.
We do not offer a separate change-of-mind refund for a monthly service period that has begun and been supplied. This does not limit any refund, cancellation, repair, compensation or other remedy available under the Australian Consumer Law or another law. We will assess service failures and disputed charges on their facts. If we end a paid service for our convenience before the end of a funded period, we will provide an appropriate refund for the unused part unless a different remedy is required by law. We will not impose a new cancellation penalty.
7. Your content and licences
You retain the rights you hold in text, images, branding and other content you provide. You warrant, to the extent reasonably within your knowledge and control, that you have rights and required permissions to upload, use and publish it, including permissions concerning people shown in images or named in content.
You give NovaSoft a non-exclusive permission to host, copy, transform and display your content only as reasonably needed to operate the features you choose, fulfil your instructions, maintain security, provide support and comply with law. We do not take ownership of your content or obtain permission for unrelated advertising. A published site is accessible to the public and can be copied or indexed by others.
NovaSoft and its licensors retain rights in the platform, templates, designs, software and supplied assets. Subject to your plan and these Terms, you may use a supplied template as part of a site created and published through NovaSoft Sites. You may not sell or distribute the standalone template, source library or supplied assets as a competing template pack. Third-party material may carry additional notices shown with that material.
8. Customer websites and visitor information
You control your site’s statements, offers, business identity and lawful notices. You must not use a site or enquiry form to collect information you are not permitted to collect. The general Grow form is not designed for card numbers, passwords, government identifiers, health information or other sensitive information.
For Grow enquiries, the form explains that the visitor’s name, email and message are stored for the verified site owner to read, may produce an email notification to that owner, and are checked by Cloudflare for abuse. The owner decides how to respond and use the enquiry and must provide any additional notice or consent needed for that use. An enquiry is not consent to marketing messages. NovaSoft remains responsible for its own processing and security obligations.
Customer sites are served from customer hosts, separate from the application origin. You must not attempt to bypass platform restrictions or introduce executable code or third-party scripts through unsupported content. We may refuse unsafe content or publication where reasonably required for security or legal compliance.
9. Acceptable use and reports
The Acceptable Use Policy forms part of these Terms. Do not publish unlawful, infringing, deceptive or harmful content; operate phishing, spam or malware; attack the service; evade plan limits; or use the platform to violate others’ privacy or rights. Report suspected abuse to help@novasofttechnologies.com with the affected URL and sufficient detail for review, without sending unnecessary sensitive material.
We may investigate credible reports, remove or restrict affected material, and preserve limited evidence where reasonably necessary. We do not promise continuous monitoring or guaranteed detection. We will consider context, urgency, proportionality and legal obligations and provide a review path where safe and practicable.
10. Availability and service changes
We use reasonable care and skill to supply the service. The service may be interrupted by maintenance, faults, internet or provider outages and security events. No fixed uptime percentage, service credit or response-time SLA is offered at launch. This does not remove rights or remedies that cannot be excluded by law.
We may make changes that improve security, reliability or usability. We will give at least 30 days’ notice to the registered account email before a material adverse change to an existing paid plan or its renewal price, where practicable, and apply a price increase only to a future renewal. The customer may cancel before that renewal without a new penalty. Urgent changes required for security or law may take effect sooner; we will explain them as soon as reasonably practicable. If a change requires fresh agreement by law, we will obtain it.
We will not silently remove already funded usage allowances during a current paid period. If a material change prevents the customer from receiving the contracted service, we will consider an appropriate remedy, including any remedy required by law.
11. Suspension and ending access
We may suspend or restrict an affected account or site where we reasonably believe there is a material breach, credible security threat, non-payment, unlawful activity or a legal requirement. We will limit the action to what is reasonably needed. Where safe and lawful, we will tell the account owner the reason and provide a reasonable opportunity to respond or fix a remediable issue. Urgent threats may require immediate action.
The owner can ask for review at help@novasofttechnologies.com. We will reassess when the issue is resolved. We may close an account after a serious or repeated breach, a legal requirement or a service discontinuation, with reasonable notice where feasible. We will assess any prepaid unused period and legal remedy fairly; closure is not a blanket forfeiture of statutory rights.
Stopping public serving does not automatically delete stored drafts, uploads, release records or billing evidence. Data requests and retention are addressed in the Privacy Policy. We do not guarantee restoration of browser-only drafts or third-party copies of a published site.
12. Exports and retention
Keep your own verified source exports of important work. The editor offers device source export; account export and deletion requests are handled through the verified support process rather than a self-service closure button. We will identify the account and site before releasing private source to a requester.
We retain information for the purposes and periods described in the Privacy Policy and as reasonably needed for service operation, security, disputes and legal recordkeeping. A request to close an account or delete information will be assessed against those purposes and applicable law. We will explain any information that must remain, including billing records or temporarily retained backup and release copies.
13. Responsibility, liability and indemnity
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. We remain responsible for our negligence, breaches and other liability to the extent required by law.
To the extent the law permits, neither party is responsible to the other for loss caused by the other party’s unlawful content, misuse of the service or failure to take reasonable steps within its control. A customer using the service for business purposes will take reasonable steps to mitigate a loss and tell us promptly of a material problem so we can investigate and try to remedy it.
To the extent the law permits for a business customer claim outside non-excludable rights, our aggregate contractual liability for ordinary loss is limited to fees paid for the affected site in the 12 months before the event giving rise to the claim. This cap does not apply to fraud, wilful misconduct, or a liability that cannot lawfully be limited.
A business customer will compensate NovaSoft for a third-party claim to the extent caused by that customer’s unlawful content or knowing infringement of a third party’s rights, after prompt notice and a reasonable opportunity to participate in the defence. This does not apply to loss caused by NovaSoft’s own breach or negligence, and it does not take away non-excludable consumer rights.
14. Complaints, law and updates
Contact help@novasofttechnologies.com with the account or site, problem and outcome sought. We will assess the complaint fairly and explain a proposed response. This process does not prevent a person from going to a court, tribunal or regulator or exercising a statutory right.
Australian law applies to these Terms. A dispute may be brought before an Australian court or tribunal with jurisdiction, subject to any mandatory consumer protection. If one term cannot be enforced, the remaining terms continue to the extent they can operate fairly.
We will identify the effective date and version of the active Terms. Material changes will be communicated appropriately to account holders; where required, we will obtain fresh agreement. The version accepted at signup is recorded. Changes do not retrospectively remove rights that have already accrued.
